Terms of Service/Terms and Conditions

Please read the Terms carefully, as they constitute a legal agreement between ExplantLab (a trading name of PXD Limited, the provider of MyOrthotype) and you. The terms are subject to English Law and jurisdiction of the courts of England and Wales. If you do not agree with these Terms and our privacy notice, you will not be able to use the Services. You can delete your account from your Account Settings at any time.

The Services

MyOrthotype provides you with a report which tells you if you have immune genes which are linked to a higher risk of an adverse immune reaction to an implant manufactured from cobalt chrome. More detail is provided on the MyOrthotype Test information page.

How is the MyOrthotype Test carried out?

ExplantLab will provide you with a self-testing kit, by post, which will require you to conduct a saliva swab, by following the instructions contained within the kit.

You will then issue the sample by post, within the provided packaging, to our carefully selected partner, who will carry out the MyOrthotype Test and send the results directly back to you via email.

All rights in the test records will be retained in accordance with our privacy notice and the consent form that you have signed.

Who can use the Services?

MyOrthotype is currently only approved for sale in the United Kingdom.

By using the Services or creating an account, you agree that:

You can form a binding contract with PXD Limited (trading as ExplantLab);

You are 18 years of age or older;

The sample you provide for MyOrthotype testing is your own.

PXD Ltd (ExplantLab) may make changes to the Terms in the future. If we make a change to the Terms, we will notify you by posting a notice on our website or sending a message to the email address you have provided in your account. By continuing to access or use the Services, you agree to be bound by the updated Terms.

Risks and considerations regarding our services

The laboratory may not be able to process your sample, and the laboratory process may result in errors.

Failure to extract DNA from the sample you provide

The laboratory may not be able to process your sample up to 5% of the time if your saliva does not contain a sufficient volume of DNA, you do not provide enough saliva, or the results from processing do not meet our standards for quality. The most common reason for sample processing failure is that the individual providing the sample has had food or fluids within thirty minutes of producing their sample. To greatly reduce the risk of sample failure, it is encouraged that you closely follow the instructions provided in the saliva collection kit.

Errors in the DNA typing

This is rare, affecting less than 1% of the tests we process.  

Samples lost in transit

We use delivery services approved and recommend by Royal Mail for transport of biological samples. While it is rare, it is possible that a sample may not reach our laboratory.

Our policy on re-processing of failed samples or samples lost in transit

If the initial processing fails for any reason, we will reprocess the same sample at no charge to the user.

If the second attempt to process the same sample fails, we will send another sample collection kit to the user to collect a second sample at no charge. If the second attempt to process the sample is unsuccessful, ExplantLab will not send additional sample collection kits and the user will be entitled solely and exclusively to a complete refund of the amount paid to ExplantLab, less shipping and handling. If a submitted sample is not received at the laboratory, we will send another sample collection kit to the user at no charge.

Sending and accessing results

Results will be sent to the email you provided to us when you set up your online account. ExplantLab will not be held responsible for any failure in your own IT systems, caused by you or your third party IT service provider. It will be your sole responsibility to check your junk/spam folder to check for receipt of the results and to ensure you have a working IT system in order to access the results.

You should not change your health choices solely on the results of the MyOrthotype test

If you have concerns or questions about what you learn through MyOrthotype testing, you should discuss this with the doctor in charge of your care. ExplantLab does not endorse, warrant or guarantee the effectiveness of any specific course of action, resources, tests, physician or other healthcare providers, medical devices or other products, procedures, opinions, or other information that may be mentioned on our website. If we provide any recommendations and/or potential ways to take action, this information is intended for informational purposes only and for discussion with your physician or other healthcare provider. The Services are not intended to be used by the customer as a substitute for professional medical advice. Reliance on any information provided by ExplantLab/ExplantLab employees, or others appearing on our website at the invitation of ExplantLab is solely at your own risk.
